Terms of Service

1. Agreement to Terms

By accessing or using TableMatch (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and TableMatch (“we,” “us,” or “our”). We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

TableMatch is a web-based tool that aggregates restaurant information from third-party sources (including the Google Places API) and provides group-based preference matching. The Service allows users to share a session link with others, collect dining preferences, and receive ranked restaurant suggestions. TableMatch does not own, operate, endorse, or guarantee any restaurant listed on the Service.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. User Accounts

You may sign in using a Google account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We do not store your account information in a persistent database — your session is held in a short-lived encrypted cookie. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts at our sole discretion.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner consistent with all applicable laws and regulations. You expressly agree not to:

  • Scrape, crawl, spider, or use automated means to extract data from the Service
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to transmit any malicious code, viruses, or harmful data
  • Use the Service for any commercial purpose without our express written consent
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Collect or harvest personal information about other users
  • Use the Service in any way that could damage, disable, or impair the Service

6. Third-Party Content and Services

The Service displays content sourced from third parties, including restaurant names, addresses, photographs, ratings, reviews, and hours of operation obtained via the Google Places API. This content is provided solely for informational purposes. We make no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any third-party content. All third-party data is subject to the terms and policies of its respective provider. We are not responsible for the content, practices, or policies of any third-party service.

Restaurant information may be inaccurate, outdated, or incomplete. You should independently verify all material information (including hours, menus, pricing, and accessibility) directly with any restaurant before visiting.

7. Shared Links and User-Generated Sessions

The Service allows you to generate shareable URLs that encode dining session data. You acknowledge that anyone who obtains your share link may view and participate in your session. You are solely responsible for the distribution of your share links. We are not responsible for any disclosure of session information that results from your sharing of links.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by TableMatch and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only. You may not copy, modify, distribute, sell, sublicense, or create derivative works based on the Service or any part thereof without our express written permission.

All trademarks, service marks, logos, and trade names displayed on the Service are the property of their respective owners.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY RESTAURANT RECOMMENDATION WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TABLEMATCH, ITS OPERATORS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless TableMatch and its operators, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your violation of any applicable law or regulation.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration body, and you waive any right to a jury trial or to participate in a class action lawsuit.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TableMatch regarding your use of the Service and supersede all prior agreements, representations, and understandings between the parties relating to the subject matter herein.

17. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
